Kelemenis & Co. advises the Albanian Transmission System Operator on regional power market coupling
Following their successful tender bid, LDK Consultants and Kelemenis & Co. have set out to support the Albanian TSO in the implementation of Terms, Conditions, and Methodologies (TCMs) to enable the integration of the Albanian power market into its Single Day-Ahead Coupling with the regional market. The project, which is funded by the World Bank, is intended to assist Albania in the transposition of the legal and regulatory framework against the requirements of the EU Target Model and associated Network Codes and Guidelines. The activities to be performed by Kelemenis & Co, as the project’s legal advisor, include: (a) review of EU legislation and particularly analysis of the CACM, FCA, SOGL, EBGL and ER NC Regulations to identify legal requirements for each TCM; (b) gap assessment findings to confirm legal gaps identified and prioritize critical issues; (c) draft legal texts, i.e. support or directly draft legal components of each TCM proposal, ensuring wording aligns with EU legal drafting standards; (d) compliance check to ensure that proposals include necessary consultation processes, impact assessments, and timelines; (e) regulatory coordination which includes liaising with the NRA (and ACER) on specific legal format or procedural issues; (f) review stakeholder inputs; (g) prepare approval documents (i.e. prepare accompanying explanatory notes, justifications, and compliance matrices for NRA submission and training sessions.
